Vacation Rental Agreement

This Vacation Rental Agreement (the Agreement) is made between the Homeowner/Property Manager and the Guest as of the date the booking was made. The parties hereby agree as follows:

1. Property

The vacation rental property is located at Mas de la Prade, 11150 VILLASAVARY, France.

The property is fully furnished and includes: see itemised inventory at Vacation Rental. The value of any items found to be missing after the Guest checks out will be deducted from the security deposit.

2. Rental Party

The rental party shall consist of the Guest and their party limited to the maximum number of guests allowed.

3. Maximum Occupancy

The maximum number of guests is limited to that specified at time of booking (including children).

4. Term of Lease

The vacation rental begins at 4pm on the date specified at the time of booking and ends at 10am on the departure date specified at the time of booking.

Failure to adhere to the check-out time may result in an additional late fee set at €50.00 unless arranged in advance. The fee will be deducted from the security deposit.

5. Rental Rules

Guests agree to abide by the Vacation Rental Rules (attached to this agreement) at all times while at the property and shall ensure all members of the rental party and anyone else the Guest permits on the property to abide by the following rules at all times while visiting or residing at the property.

6. Access

The Guest shall allow the Homeowner/Property Manager access to the property for purposes of repair, inspection or emergency. The Homeowner shall exercise this right of access in a reasonable manner by giving at least 2 hours notice (unless in case of emergency).

7. Rental Rate and Fees

a) Security Deposit: A pre-authorization of EUR 150.00 is due 1 days before arrival and released 2 days after departure provided no deductions are made due to:

  • damage caused to the property or furnishings
  • dirt or other mess requiring excessive cleaning
  • any other cost incurred by the Homeowner due to the Guest’s stay

b) Rental Rate: Payment in full at time of booking as shown on the online booking form.

c) Taxe de Séjour: We are required to collect a local holiday tax of 4% of the per person rate/per night (excluding under 18s) plus 10% departmental tax and 34% regional tax. This is payable during the booking process.

8. Cancellation Policy

If the Guest wishes to cancel the reservation a refund will be made according to the rental policy at time of booking or as follows:

100% if cancelled 7 days prior to the check-in date

0% if cancelled less than 7 days prior to the check-in date

The Homeowner may also be entitled to cancel the Guest stay if house rules are broken during the rental period with no refund.

9. Insurance

We encourage all renters to purchase travel insurance in case of unforeseen circumstances, accidents or other issues that may prohibit the Guest from travelling or fulfilling the rental terms.

10. Payment

Acceptable payment methods are: credit card

All payments, unless otherwise specified will be processed on the vacation rental website at www.route371.com

By proceeding with the booking and payment the Guest hereby gives permission to charge their credit card for the amount specified on the booking page. The Guest agrees that all rental monies are non-refundable as per cancellation policy above. The Guest has read their rights to purchase travel insurance.

Vacation Rental House Rules

Complying with these House Rules at the Vacation Rental Property is a requirement of the Vacation Rental Agreement. Failure to adhere to the below House Rules may result in penalties such as deductions from the security deposit.

1. General Requirements

a) All Guests (and any Visitors) must comply with all House Rules and any other instructions from the Property Manager during their stay; and

  • b) Guests must notify the Property Manager of any disputes or complaints from neighbours as soon as reasonably practicable.

2. Noise and the neighbourhood

a) Guests are fully responsible for the safety and security of their children at all times, as well as any disturbance caused to other residents at the property or in the neighbourhood.

b) Guests and Visitors must keep noise to a minimum so as not to disturb the occupants of neighbouring properties – especially at night between 12am and 8am, and upon arrival and departure.

c) Excessive noise is prohibited at all times and may result in termination of the vacation rental agreement, eviction, loss of rental paid and extra charges which may be deducted from the Security Deposit.

3. Visitors

a) Guests are allowed a maximum of 4 Visitors at any time during their stay upon request.

b) Guests are responsible for ensuring maximum visitor numbers are not exceeded; and that Visitors are made aware of these House Rules.

c) Any additional overnight Visitors must be approved in advance during the booking process and are subject to an additional fee. The Property Manager reserves the right to refuse entry to the property of any person in excess of the numbers agreed.

4. Functions

a) Parties and large gatherings of any kind are strictly prohibited at the Vacation Rental; and

b) Any small gathering must comply with other rules set regarding Noise, the Neighbourhood and Visitor numbers.

5. Parking

a) Guests and any Visitors are to comply with parking regulations and other requirements set out below and show consideration to neighbours and other vehicles;

b) Parking arrangements at the Vacation Rental are as follows:

Free parking is available at the Vacation Rental. Vehicles must be parked so as not to block any other vehicles. A maximum of 2 vehicles per Guest are permitted to ensure there is space for all other Guests.

All Guests must enter the property from the D371 road marked with the name of the property at the entrance. All other routes are prohibited.

6. Garbage and Recycling

a) Guests and their Visitors are to dispose of Garbage and Recycling in accordance with the usual practice at the Vacation Rental (as set out below) in the allocated trash cans, and excess rubbish must not be left in public or common areas; and

b) Garbage and Recycling arrangements at the Vacation Rental are as follows:

  • Glass bottles and jars are to be recycled at local bottle banks which can be found near the village at Chemin de la Barthe and Avenue du Dr Combes (adjacent to le Stade).
  • Plastic bottles and food trays, foil and cardboard are to be placed in the yellow bins at the end of the driveway on the crossroads.
  • General household and cooked food waste is to be disposed of in the main green bin at the end of the drive at the crossroads.

Uncooked vegetable matter may be disposed of in the compost bins behind the walled garden.

7. Security

a) Any time Guests leave the Vacation Rental, it is their responsibility to ensure all windows and doors are closed/locked to maintain security and prevent rain and water damage.

b) Guests must switch off lights, fans, electronics such as televisions when not in use to promote energy saving.

8. Swimming Pool

a) The pool is only to be used from 9.00am until 7.00pm so cleaning can take place outside these hours.

b) Children under 16 must be accompanied at all times in the pool area. The gate must always be shut when leaving the pool area unattended.

c) No glass or china is allowed in the pool area for your safety. Please use plastic glasses provided. Smoking is permitted in designated area only. Please keep noise to a reasonable level to respect the enjoyment of other guests and our neighbours.

9. Smoking

a) Smoking is not permitted inside the Vacation Rental; and

b) Cigarette butts must be disposed of properly (i.e. in ashtray provided) and not thrown on property grounds. Failure to do so will result in a deduction from the security deposit.

10. Pets

a) Pets are permitted at the Vacation Rental;

b) Specific rules regarding Pets at the Vacation Rental are as follows:

  • Pet owners must keep control of their animals at all times and must not allow their pets to disturb other Guests.
  • Fouling must be cleared up immediately and disposed of in the main bin at the entrance to the property.
  • Damage to furniture or other Property caused by pets will be deducted from the Security deposit.

11. Barbecue

BBQs can become very hot and are used at Guests’ own risk. They must be cleaned after use.

12. Damages, Breakages and Losses

We ask you to respect the property and amenities provided and leave things in the same condition as when you arrived for your enjoyment and that of our other guests.

a) All Damages and Breakages must be reported to the Property Manager as soon as reasonably practicable. Failure to do so may result in a deduction from the security deposit; and

b) To avoid Damages and Breakages, no furniture is to be moved from one room to another without prior agreement and Guests must not sit on furniture and beds in swimwear to avoid sun cream damage.

c) All kitchen appliances, crockery and cutlery are for use in the Vacation Rental or on the terrace only and must not be removed from the property. Please ask if you require anything to take off site. Adaptor plugs in the gite are for the convenience of you and other guests and must not be removed from the gite.

d) Lost keys will incur a charge of €25 which will be deducted from the security deposit.

13. Toilets

All toilet waste drains into a septic tank. Guests must ONLY place toilet paper in the toilet and use sparingly to avoid blockages. All other products should be disposed of in the bathroom bin. A call out charge will apply for any blockage and repair caused.

14. Linen and Towels

Bed linen, pillows, bath & hand towels are provided for each week booked. If you require clean bedding or towels please ask. There is an additional charge for laundry services. Pool towels are provided. Please re-use these for your stay to help us to conserve water. Beach towels are available on request. Bath and pool towels must not be removed from the property.

15. Check-in and Check-out arrangements

a) Arrival/check-in is from 4.00pm to 10.00pm. Check-out is by 10.00am.

  • Please inform the Property Manager if you need to arrive or depart outside these times. You are welcome to store your luggage with us while your gite is being prepared or while waiting for your flight or onward travel.

b) If the Property Manager is not available at time of departure please leave your key in the key safe.

c) Garbage should be removed from Vacation Rental on departure.

17. Compliance

a) Breach of any of these House Rules is a breach of the Terms and Conditions of occupancy as per the Rental Agreement.

b) The Owner and Manager reserve the right to terminate permission to occupy and to evict from the Vacation Rental, any Guests or Visitors who refuse to follow these House Rules or who cause a nuisance to neighbours or other Guests.
